Executive Order #D 2020 260

Polis’ Executive Order #D 2020 260 to transfer Covid positives to care facilities, nursing homes, dorms, etc

With 1088 “Covid deaths” total ~ 718 nursing home deaths in a state of 5.7 million, resulting in lock down over 370 deaths outside nursing homes and over the age of 70. Colorado taxpayers spent millions of dollars building isolation facilities that sat empty at a significant monthly cost while hundreds of patients were transferred to our nursing homes and college dorms. Most were in Denver and Arapahoe Counties where hospitals sat empty with all “elective” surgeries postponed. Covid patients would have been housed in empty hospitals if the intent was to truly save lives instead of a political ploy with deaths being collateral damage.

Governor Polis Executive Orders - A Closer look

D2020-001 Activating the CO National Guard to assist with election Cyber Security Defense Efforts During The Presidential Primary Elections.

This EO was released on Feb 26, 2020, before the COVID-19 virus was recognized as a major health concern. It states that the National Guard can be employed by the governor for the defense of the state. Curious, I don’t remember the National Guard being deployed when rioters were trying to burn the downtown area down later last year.


B2020-001 Ordering the temporary Suspension of Certain Regulatory Statutes Due To The Presence Of Covid

II Directives

  1. Suspend license limitations to allow retailers to sell and deliver alcohol beverages and beer.
  2. Suspend personal physical exam for a medical marijuana card
  3. Allows pickup of marijuana from retail stores without going into the stores


*It is nonsense that in the very earliest executive orders, people are not only given access to booze and weed, but the process for obtaining it is made not only easier, but effortless.  Identification of the purchaser and age verification are left wide open and very difficult to control.


C2020-001 Commutation of Nathan Dunlap’s sentence from the death penalty to life imprisonment without parole.

*His first EO regarding judicial processes is to release the arguably most notorious criminal currently in the Colorado justice system (Chuck E Cheese murderer) from the death penalty.


B2020-002 Creating the ‘Governor’s Advisory Committee for Cooperation and Implementation


The ‘Stay at Home’ order and ‘New Normal’ order came out in March/April 2020. With the clauses contained


B2020-003 Rename governor’s ‘New Normal’ advisory board to ‘Governor’s Advisory Committee for Cooperation and Implementation. 

 

This order promulgates that citizens must remain indoors and six feet away from each other. 


 *By what right does a person in an elected capacity have the ability to make such a drastic change in a free society? This order says “Evidence has shown that social distancing and the Stay at Home Order are working, and the increase in COVID-19 cases and the rate of infection has slowed,” but provides nary a hair of evidence by way of charting, or verbiage. So, from what I can gather, the ‘New Normal’ consists of lockdowns, closed or abbreviated businesses, a warped ideal of ‘essential businesses’, social distancing and face masks.

**This EO was written on May 6, 2020! The country didn’t know much of anything about the virus at this point. By what measuring stick does this order say that the draconian measures were effective? Nothing changed! Infections continued to grow, and ‘deaths’ continued to mount. This can’t even be considered as bad marketing!! Also, Polis HAD to have foresight from the mothership on what course this scare was going to take. There had to be collusion between Fauci, Biden and Polis to be able to concoct these restrictions so early in the game.


B2020-004 Create Colorado Geographic Naming Advisory Board

Created to assign race sensitive names for Colorado natural sites Q: Why would this not be set up for a vote to avoid contention? Or, why waste time on this at all??


D2020-003 Declaring a Disaster Emergency Due to the Presence of Coronavirus Disease 2019 in Colorado 

*It is curious to note that this Executive Order came out at the same day and time the WHO declared covid to be a pandemic.


D2020-013 Ordering Colorado Employers To Reduce In-Person Workforce by Fifty Percent Due to the Presence of COVID-19 in the State 

I, Jared Polis, Governor of the State of Colorado, hereby issue this Executive Order ordering Colorado employers to reduce in-person work requirements by fifty percent for non-critical workplaces due to the presence of coronavirus disease 2019 (COVID-19) in the State. 

Certain employers must continue to function at full capacity during regular business hours to provide goods and services critical to our response to the COVID-19 epidemic emergency.


D2020-16 Temporarily Suspending Certain Regulatory Statutes Concerning Criminal Justice 

I, Jared Polis, Governor of the State of Colorado, hereby issue this Executive Order temporarily suspending certain regulatory statutes concerning criminal justice due to the presence of coronavirus disease 2019 (COVID-19) in Colorado. 

  1. In compliance with Centers for Disease Control and Prevention’s (CDC) Interim Guidance on Management of Correctional and Detention Facilities, I temporarily suspend the Colorado Department of Corrections’ (DOC) duty to receive and take custody of prisoners pursuant to C.R.S. § 16-11-301 and -308. I direct DOC to identify the criteria that would justify the acceptance of such prisoners. Offenders shall remain in any pre-transfer facility until otherwise directed by the DOC. 
  2. I temporarily suspend the caps and criteria on awards of earned time credits set forth in C.R.S. § 17-22.5-405. During this time, DOC shall have the discretion to make awards of earned time credits as it deems necessary and appropriate to safely facilitate the reduction of the population of incarcerated persons and parolees to prevent an outbreak in prisons. 
  3. I temporarily suspend the provisions of C.R.S. 17-1-104.3 (1)(b.5), addressing the custody level of offenders and duration of time for which the DOC may incarcerate persons at the Centennial Correctional Facility- South, operated by the DOC and located at the East Cañon Complex in Cañon City, Fremont County, so as to make the 650 beds at that facility available to the DOC to house persons of mixed classification for operational needs related to the COVID-19 outbreak. 


*The way I read this is that the Department of Corrections is being told to suspend the Colorado Regulatory Statutes (CRS) to minimize prisoner intake. At the East Canon Facility in Canon City, Polis wants to free up 650 beds to use for inmates across the level of classifications. Classifications are from Level 1-5, meaning the level of prisoner restriction, Level 5 being the most secure, or most serious crime level, if you will.


D2020-017 Ordering Coloradans to Stay at Home Due to the Presence of COVID-19 in the State 

  1. I direct all Coloradans to stay at home, subject to limited exceptions such as obtaining food and other household necessities, going to and from work at critical businesses, seeking medical care caring for dependents or pets, or caring for a vulnerable person in another location. 
  2. I direct all businesses other than those qualified as “Critical Businesses” under Public Health Order 20-24 or any Public Health Order issued pursuant to this Executive Order, to close temporarily, except as necessary to engage in minimum basic operations needed to protect assets and maintain personnel functions, as of the effective date of this Executive Order., caring for dependents or pets, or caring for a vulnerable person in another location. 


D2020-027 Cessation of ALL elective and non-essential surgeries

*Includes medical, dental and veterinary. Again, how does a politician have the power to make a medical call?


D2020-29 Suspension of Regulatory Statutes Due to Covid


*One item in this EO is that weed can be ordered/purchased online and delivered. No mention of ID of any sort.

Suspension of fingerprint based background checks – Suspend requirement that a sex offender, required to register as one, has to take a photograph or fingerprints! This loses control and monitoring capability of one of the most predatory types of criminal.


D2020-064 

Ordering the Temporary Suspension of Certain Regulatory Statutes Concerning Signature Collection for Unaffiliated and Independent Candidates and Authorizing the Secretary of State to Create Temporary Rules for Registered Electors To Receive and Return Candidate Petitions Over Mail and Email Due to the Presence of COVID- 19

 

*This largely does away with identification verification.


I, Jared Polis, Governor of the State of Colorado, hereby issue this Executive Order ordering the temporary suspension of certain regulatory statutes concerning signature collection for unaffiliated and independent candidates who are required to file petition with the Secretary of State under Title 1 and authorizing the Secretary of State to create temporary rules to allow for mail and email signature collection due to the presence of coronavirus disease 2019 (COVID-19) in Colorado. 

  • I temporarily suspend the requirements of C.R.S. § 1-4-901 designating the format of petitions for unaffiliated and independent candidates filed with the Secretary of State’s Office. 
  • I temporarily suspend the requirements of C.R.S. § 1-4-905(2)(a) that a circulator for unaffiliated or independent candidates must provide an affidavit stating that the circular was in the presence of the person who signed the petition and that the affidavit is signed in the physical presence of a notary public for petitions filed with the Secretary of State 
  • I temporarily suspend the requirements of C.R.S. § 1-4-905(3) requiring the Secretary of State to reject any section of an unaffiliated or independent candidate petition filed with the Secretary of State’s Office that does not have a notarized circulator affidavit attached. 
  • I temporarily suspend the requirements of C.R.S §§ 1-4-908(1.5) and (3) requiring the Secretary of State to compare signatures on an unaffiliated or independent candidate petition with signatures found in the statewide voter registration database and requiring the Secretary of State to provide notification of sufficiency or insufficiency no later than ninety-six days before the general election. 


PHO 20-38 Fourth Amended Public Health Order Limited Covid 19 Restrictions


“I have issued public health orders pertaining to the limitation of visitors and nonessential individuals in skilled nursing facilities, intermediate care facilities, and assisted living residences; defining the terms of the governor’s ‘Stay at Home, Safer at Home, and Protect our Neighbors’ requirements as well as ‘Critical Business’ designations; requiring hospitals to report information relevant to the covid response, and requiring the wearing of face coverings in the workplace and urging their use in public. These measures all act in concert to reduce the exposure of individuals to disease and are necessary steps to protect the heath and welfare of the public. Additionally, in reducing the spread of disease, these requirements help to preserve the medical resources needed for those in our communities who fall ill and require medical treatment, thus protecting both the ill patients and the healthcare workers who courageously continue to treat patients.”


*What does “requiring hospitals to report information relevant to covid” mean? The ‘Stay at Home’, Safer at Home and Protect our Neighbors’ are all undefined. (see D2020 235)


D2020 235  Superseding and Replacing Executive Orders Concerning Protect Our Neighbors and Safer at Home in the Vast, Great Outdoors and Establishing Directives for the COVID-19 Dial Framework 


*This EO defines the ‘Dial’ restrictions, percentage of employees allowed to work at a business at a given time, how businesses and schools are to function and behave, and other controls that the State has over businesses and employees. A couple of examples:

  • Any county in Levels Blue and Yellow of the Dial wishing to apply for a local site-specific variance of this Executive Order must submit a written application to CDPHE. CDPHE shall define any criteria required for approval of a local site- specific variance. 
  • I direct all Coloradans who reside in counties under Level Red of the Dial to stay at home, subject to the exceptions as defined in the PHO issued pursuant to this Executive Order. 
  • I direct the Executive Director of the Colorado Department of Higher Education (CDHE) to continue to work with CDPHE to identify programs and courses at postsecondary institutions that cannot be taught remotely and require limited in person instruction, and CDPHE shall create appropriate guidelines for classes and programs identified in consultation with the Executive Director of CDHE pursuant to this Section III.F. 
  • I direct the Executive Director of CDLE to modify temporary emergency rules as necessary pursuant to C.R.S. § 8-73-108(4)(c) and guidance as necessary to ensure that workers, and particularly workers who are individuals at risk of severe illness from COVID-19, are not in danger of losing unemployment insurance eligibility for refusal to return to COVID-19-related demonstrable, unsafe working conditions. 
  • *I don’t see anything in ‘H’ about verification of risk of illness or illness.
  • Based on each county’s status in Levels Blue, Yellow, and Orange, all licensees licensed pursuant to Articles 3, 4 and 5 of Title 44 of the Colorado Revised Statutes, including approved sales rooms licensed under C.R.S. §§ 44-3-402(2), 44-3-402(7), 44-3- 403(2)(e), or 44-3-407(1)(b), that are licensed for on-premises consumption of alcohol beverages must make meals prepared by a retail food licensee available at all times that alcohol beverages are served for on-premises consumption, subject to the requirements of any relevant PHOs.
